Temporary Graduate Visa Changes Australia 2024: Key Updates and Impacts

Crucial Temporary Graduate Visa Changes Australia 2024: Key Updates and Significant Impacts The Australian Government is enacting stricter migration rules starting 1st July 2024 to curb visa hopping, a practice where temporary visa holders continuously extend their stay in Australia by switching between various visa categories. This will significantly impact many temporary visa holders currently residing in Australia. Below are the three key changes: Key Changes to Australia’s Migration Rules to Stop Visa Hopping from 1st July 2024 The Australian Government is enacting stricter migration rules starting 1st July 2024 to curb visa hopping, a practice where temporary visa holders continuously extend their stay in Australia by switching between various visa categories. This will significantly impact many temporary visa holders currently residing in Australia. Below are the three key changes: Prohibition on Student Visas for Visitor Visa Holders Effective 1st July 2024, individuals holding visitor visas (subclass 600) will no longer be eligible to apply for student visas while in Australia. This measure is designed to prevent the growing number of people who use visitor visas as a stepping stone to bypass offshore student visa checks and enter Australia for educational purposes. The government aims to ensure that student visa applications undergo rigorous assessment processes outside Australia, maintaining the integrity of the educational migration system. Restrictions for Temporary Graduate Visa Holders Temporary Graduate Visa holders (subclass 485) will be restricted from applying for student visas onshore. This policy change seeks to discourage graduates from prolonging their stay in Australia by returning to study instead of pursuing skilled employment or returning to their home countries. By enforcing this restriction, the government intends to streamline the transition of graduates into the workforce or their departure from Australia, aligning with the broader goals of skilled migration and reducing temporary visa extensions. Additional Changes for Temporary Graduate Visa Holders Several other modifications will be made to the conditions of the Temporary Graduate Visa (subclass 485): Shorter Post-Study Work Rights: The duration of post-study work rights for graduates will be reduced, limiting the time they can remain in Australia after completing their studies. Reduced Age Limit: The maximum age limit for applicants will be lowered from 50 to 35, targeting younger, skilled individuals and aligning with global trends in migration policies. Higher English Language Requirements: Stricter English language proficiency standards will be imposed, ensuring that graduates have a high level of language skills necessary for integration into the Australian workforce. Summary:These measures aim to reduce net overseas migration and close existing loopholes in the migration system, fostering a more strategic approach to international education and skilled migration in Australia. By tightening these rules, the government seeks to ensure that the migration system better supports the nation’s economic and social objectives while maintaining the integrity and efficacy of its visa programs. The focus is on creating a balanced and sustainable migration framework that prioritizes skilled migration, enhances the quality of international students, and ensures that temporary visa holders contribute meaningfully to the Australian economy. By addressing visa hopping and implementing these targeted changes, the government aims to streamline the migration process, reduce undue pressures on the immigration system, and promote long-term benefits for both migrants and the broader Australian community. Maintaining Age Limit at 50 for Subclass 485 Visa: What It Means for Master’s and PhD Graduates

Maintaining Age Limit at 50 for Subclass 485 Visa: What It Means for Master’s and PhD Graduates Starting from 1 July 2024, the Department of Home Affairs will maintain the maximum age limit at 50 years for applicants seeking the Subclass 485 Temporary Graduate Visa in the Post-Higher Education Work stream. This visa, previously known as the Post-Study Work stream, provides international students who have completed an eligible qualification the opportunity to stay in Australia temporarily to live, study, and work. The age limit of 50 years of age at time of application will also remain for holders of Hong Kong and British National Overseas (BNO) passports for both streams. Implications of the Age Limit Maintenance Extended Opportunities for Older Graduates The decision to keep the age limit at 50 years is significant for older graduates who have completed a master’s (research) or doctoral degree (PhD). This ensures that mature students and mid-career professionals who return to study are not disadvantaged by a lower age limit. It acknowledges the contributions that older graduates can make to the Australian workforce and economy. Encouraging Higher Education Enrolments By maintaining a higher age limit, Australia continues to attract international students, including those pursuing advanced research degrees. This could lead to increased enrolments in master’s (research) and PhD programs, positioning Australia as a preferred destination for higher education. Contribution to the Australian Workforce Graduates with advanced degrees possess specialized skills and knowledge that can significantly benefit the Australian economy. Allowing these graduates to stay and work in Australia, irrespective of their age up to 50, helps address skill shortages in various sectors. This contributes to a more skilled and diverse labour market. Alignment with Skilled Migration Goals The policy aligns with Australia’s broader migration strategy, which aims to attract highly skilled individuals who can contribute to the nation’s growth and innovation. It supports the integration of experienced professionals into the workforce, fostering a dynamic and skilled labour market. Visa Application Considerations Applicants must be mindful of the specific requirements and deadlines associated with the Subclass 485 visa. Ensuring that their qualifications are recognized and meeting other eligibility criteria, such as English language proficiency and health and character requirements, are essential steps in the application process. Potential for Future Policy Adjustments While the age limit is maintained at 50 for now, future changes to immigration policies could occur based on economic needs, labour market trends, and government priorities. Stakeholders should stay informed about any legislative updates that may affect visa eligibility. Next Steps for Potential Applicants If you are a master’s (research) or doctoral degree graduate considering applying for the Subclass 485 visa, here are some steps you can take: Review Eligibility Criteria: Ensure you meet all the requirements for the visa, including qualification recognition, English language skills, and health and character checks.
