Partner/ Spouse Visa: 

Partner Visa Subclass 820/801/309/100

Eligibility- Partner(Provisional) Visa Subclass 309 /820

  • You must spouse or de facto partner of an Australian Citizen/ PR or Eligible NZ Citizen (Same sex allowed)
  • You and your spouse must be committed to a shared life together 
  • Your relationship with your spouse must be genuine and continuing 
  • You must live with your partner or do not live apart permanently
  • Your marriage must be valid under Australian Law (married people only)
  • Your relationship must have existed for minimum of 12 months, if you are not married (De facto partners only)
  • You and your partner must be at least 18 years old 
  • You must be sponsored by your spouse/ partner
  • You both must have met in person before lodging the visa application
  • Your marriage must be supported by two witnesses who are Australian Citizens/ PR/Eligible NZ who know you and your partner for at least 12 months
  • Your partner must not have sponsored his/her previous partner in the last 5 years
  • If you are in Australia, you must hold the substantive visa 
  • You meet the health requirements and character requirements

Partner(Migrant) Visa Subclass 100/801

Eligibility Criteria:

  • Must hold visa subclass 309/820 or visa subclass 445 (if child)
  • Must have been in relationship for minimum 2 years 
  • Must continue to be the spouse/ de facto partner 
  • Have a genuine and continuing relationship 
  • Live together or not live permanently separate 
  • Be mutually committed to a shared life excluding other partners

Perspective Marriage Visa (Subclass 300) 

This visa allows you to come to Australia to marry your prospective spouse and then apply for a partner visa

Eligibility: 

  • You are in a relationship with someone overseas and want to bring him/her in Australia before getting married
  • You must be sponsored by Australian Citizen/PR/Eligible NZ Citizen
  • Meet the health and character requirements
  • Visa is granted for 9 months 
  • You need to get married within 9 months after the visa grant and apply for Partner Visa

New Zealand Citizen Family Relationship Visa -Subclass 461 

This visa is for a person who is not a New Zealand citizen but a member of the family unit of New Zealand Citizen and want to join his/her partner in Australia. This visa is granted for five years.

Eligibility: 

If you are in Australia, you must hold a substantive visa 

Your New Zealand family member/ partner must have a Special Category Visas subclass 444

You must maintain health cover for the entire period of visa 

You must provide the evidence of relationship with your New Zealand family member 

Benefits:

You can live, work and study in Australia for five years 

Travel to and from Australia as many times as you want while the visa is still valid 

You can include members of the family unit in your application
